New TSA Freight Rail Security Regulations Effective April 1, 2009

To further improve the secure transportation certain hazardous materials, including toxic inhalation and poison inhalation hazard commodities (TIH/PIH), the Transportation Security Administration (TSA) requires shippers tendering shipments of TIH/PIH materials to abide by the TSA’s updated Freight Rail Security Rules that go into effect on Wednesday, April 1, 2009.

This change affects all Rail Security Sensitive Materials (RSSM), which includes TIH/PIH, more than 5,000 lbs of a division 1.1, 1.2, or 1.3 Explosive material and Class 7 radioactive materials for both shippers and receivers.

Pulling loaded cars from industry – Will require an attended transfer of custody from customer to BNSF, including recording the full name of a customer representative who is on site at the time of transfer. BNSF will record that name.

Spotting loaded cars to an industry located within a High Threat Urban Area (HTUA), as defined by the TSA – Will require an attended transfer of custody from BNSF to customer, including full name of a customer representative who is on site at the time of transfer. Non-compliance of this policy may result in freight delays and assessment of any applicable assessorial charges. All customers are encouraged to work with their receivers to ensure understanding of the TSA rule changes.

BNSF crews will begin testing this process change on Tuesday, March 24, 2009, to ensure compliance by the TSA’s mandatory April 1 date.

The policy, as described above, will be incorporated into BNSF’s applicable rules publications, including BNSF Rules Book 6100-A, effective April 1, 2009.
