UPDATE: Billing Procedure for BNSF Traffic to/from Stations Located on Panhandle Northern Railroad

As reported previously, BNSF has taken legal action to challenge the attempt by Panhandle Northern Railroad (PNR) to disrupt operations on the line between Borger, Texas and Panhandle, Texas by imposing new rates and billing procedures on customers shipping traffic on that line. The case is pending in the federal district court for the Northern District of Texas. In an effort to ensure the continuation of freight transportation for customers shipping traffic on the line between Borger and Panhandle, BNSF has made the following arrangements related to the charges that PNR began directly assessing on January 1, 2017.

Public Price (Tariff & Open Quote) Customers: Effective February 15, 2017, BNSF will be changing our various public price documents to assess BNSF prices to and from our interchange with the PNR at Panhandle, Texas rather than pricing all the way to Borger for the PNR locations. PNR will be billing customers directly for their portion of the movement. For outbound shipments, customers should continue to show the same shipper information and change their bills of lading to BNSF to show a rail origin of Panhandle, TX. For inbound shipments, customers should continue to route their bills of lading via BNSF with the same consignee information and change the rail destination to Panhandle, TX. The arrangements described above are intended to reduce customer confusion and facilitate the continuation of service to BNSF customers, and BNSF in no way consents to PNR's charges to BNSF customers. BNSF expressly reserves its claims in connection with the currently pending lawsuit, and will continue its vigorous litigation of the case.
