Update to Policy Changes to Enhance Transportation Safety of Hazardous Materials Effective January 1, 2008

In a Marketing News on April 9, 2007, BNSF announced that it will provide discounted rates to shippers who transport toxic inhalation and poison inhalation hazardous commodities (TIH/PIH) in improved tank cars.

Effective January 1, 2008, tariff discounts for TIH/PIH commodities will be based on the most improved and enhanced tank car identified by the Association of American Railroads (AAR) as the DOT specification tank car 112J500W for anhydrous ammonia and 105J600W for chlorine, or any new DOT specification tank car that meets or exceeds this performance standard.

The following discounts to the published tariff will apply, beginning January 1, 2008:

Retroactive Discount Credits
Responding to the concerns that our customers have expressed about the availability of the improved tank cars after the January 1, 2008, effective date, retroactive discount credits will be offered for any new DOT specification tank car 112J500W (anhydrous ammonia) and 105J600W (chlorine), or for any new DOT specification tank car meeting their performance standard, which are placed into service on BNSF during the period January 1, 2008 – December 31, 2009.

Procedures on how you can apply for the retroactive discount credits will be made available by August 1, 2007.
