Agricultural Products Customers Clean Car Program Effective January 1, 2007

BNSF continues to solicit your help to ensure that railcars are completely unloaded and free of any product or material. On September 14, 2005, an ACRES announcement concerning the importance of clean equipment was published on our website at the following site:http://www.bnsf.com/markets/agricultural/ag_news/misc/Acres091405.pdf

Maintaining railcar cleanliness provides suitable cars for their next loads and saves you money by keeping railcars available for your use. Completely unloading and releasing clean cars will improve car availability for your product supplier, facilitate timely shipping, promote product arrival in damage-free condition, and prevent avoidable charges to your company.

Dirty Car Tracking Process and Penalties
(1) Prior to release of empty cars, the receiver has the responsibility for cleaning lading residue and debris from the interior of the rail equipment. Failure to do so will subject the receiver to a minimum $500 per car charge (BNSF Rules Book 6100, Item 3251). Charges may be more if the cost to reposition the car for cleaning, disposal, and return to service exceeds $500 per car (BNSF Rules Book 6100-A, items 3250 and 3251).

(2) The shipper of any railcar found to be contaminated with product or residue left on top of the railcar will be subject to a minimum charge of $500 per car.
